Truehope Found Not Guilty

On Friday, July 28, 2006, Judge Gerald Meagher of the Alberta Provincial Court Criminal Division found Truehope "Not Guilty" of selling EM Power without a Health Canada required Drug Identification Number (DIN). The decision was the result of a trial, which took place in Calgary in March of 2006.

While Truehope was clearly selling the product illegally, Judge Meagher accepted the Truehope defense that there was a necessity to continue to sell the product, as the health benefits presented during the trial outweighed the presented costs of ceasing to provide the product to the mentally ill community. Judge Meagher also felt Truehope had a due diligence defense to continue to sell the product in light of the presented benefits of the product.

The Truehope defense relied heavily on expert witness testimony from controversial Calgary child psychologist Dr. Bonnie Kaplan and a Boston area clinical psychiatrist Dr. Charles Popper. As well, Truehope provided a number of customers who gave testimonial evidence of the benefits of the product.

Rather interestingly, Health Canada never really challenged the Defense "necessity" argument. Heath Canada did not provide any expert witnesses to challenge the Defense testimony.

The verdict likely will end a battle between Health Canada and Truehope that has gone on since 2002.
