Alberta Minor Injury Battle Continues
On February 8, 2008, Alberta Queen's Bench Judge Neil Wittmann struck down Alberta's controversial Minor Injury Law which limited soft tissue injury awards from car accidents to $4000. To read the CBC's coverage of the story click here.
The Minor Injury Law was part of Alberta's 2004 insurance law reforms, and seemed to be brought about for the explicit purpose of keeping insurance rates lower. The law was vehemently opposed by much of the legal community, most prodominantly the personal injury specialty. Click here to read one law firms' statement on this matter.
The controversial law had a significant effect on the private investigation business in Alberta, especially with those firms which worked in the insurance surveillance specialty.
Since February 8th, 2008, the Alberta Government has announced it will appeal the decision to strike down the law. On February 25th, 2008, the Government applied for a stay on striking down the law, pending the appeal.
